Ecuador: Judicial decision reopens the debate on the regulation of slot machines

The District Administrative Litigation Court ordered the Municipality of Guayaquil to remove the closure seals placed on the establishment Club del Sol, where a slot machine hall operates under the control of the Ecuadorian Cystic Fibrosis Foundation.
It is time to definitively clarify whether slot machines and other gambling activities can be offered in Ecuador, both physically and remotely. The debate dates back to the Popular Consultation of May 7, 2011, which resulted in the prohibition of gambling businesses such as casinos and slot machine halls. However, since then the regulatory development has been imprecise and incomplete.
Today, with the legalization of sports predictions — considered betting activities that are not games of chance under Ecuadorian legislation — it becomes necessary to comprehensively regulate the four categories that have emerged from this fragmented framework: games of chance for profit, games of chance not for profit, sports predictions for profit, and sports predictions not for profit. The appropriate approach would be to regulate all betting activities, regardless of whether their outcome depends predominantly on chance or skill.
For now, the judicial decision in the Club del Sol case could become a key precedent. These judicial disputes could be avoided if clear rules were established for all participants. Ultimately, the central question that legislators must address is whether non-profit entities — such as the Ecuadorian Cystic Fibrosis Foundation — should be allowed to finance their activities by offering betting activities to the public.
